Legal

Terms

The conditions behind a connection, in the words we would use on the phone. Buy something that runs in your shop every day and you should be able to read what you are agreeing to without a lawyer sitting next to you.

What this page is

A plain explanation of the commercial conditions, written so you can judge the offer before you ask for a quotation. It is not the contract. What you sign is the quotation, and where the two differ the quotation wins.

Formal general terms and conditions: [verwijzing naar de formele voorwaarden].

What you are buying

A connection. One shop on one domain, or one ERP installation. That is the billable unit, and it is the same unit everywhere:the pricing page prices it, the portal lists it, and the invoice counts it. A second shop on a second domain is a second connection.

A connection gives you three things that only work together:

  • The adapter for your platform, installed in your own shop or ERP, with access to the update channel for as long as the subscription runs
  • Access to the connector, which is the only thing that talks to pCon, through a key issued to you and bound to your domain
  • Your own account in the portal, where you see your connections, manage your keys and set the configurator profile for each shop

What is not included

Three things cost money and are not ours to sell, so budget them separately.

  • Your pCon licence. You buy pCon.ui or pCon.basket from EasternGraphics or their reseller, in your own name. We never resell it and we never own it on your behalf.
  • Your shop or ERP itself, its hosting, and the work your agency does inside it.
  • Work beyond the standard scope, such as a second storefront, a bespoke import, a theme change or a migration. That is quoted separately, and never started without you saying yes to the amount.

When it starts and how it ends

The subscription starts [start van het abonnement] and runs for [contractduur], after which it renews for the same period unless you say otherwise. Notice period: [opzegtermijn]. Price changes: [prijswijzigingen].

Paying yearly costs the same as ten monthly payments, so two months are free. Amounts exclude VAT. Onboarding is invoiced once, at the start.

What onboarding delivers

Onboarding is a one-off amount per connection, and it is a delivery rather than a setup fee. When it is finished you have:

  • The adapter installed and connected, with a key bound to your domain
  • The request to EasternGraphics handled on your behalf, including the domain whitelist on your own gatekeeper
  • A representative part of your catalogue imported, with the language chain checked per manufacturer, because the wrong order there silently imports everything in the wrong language
  • One configuration driven through the configurator into a real order or quotation, with the signed price verified
  • A short handover, so your own people can do the recurring work

If any of those cannot be delivered because something outside our reach is missing, we say so before invoicing it, not after.

What support covers

Questions about the adapter, the connector and the import, by email atinfo@bewisesolutions.com. Response target: [reactietermijn]. There is no telephone support line and no out-of-hours service; promising one we cannot staff would be worth less than saying this.

Not covered: work inside your shop or ERP that is not ours, changes you or your agency make to the theme or the checkout, and problems with data a manufacturer publishes. We will usually tell you what we see, because an answer costs us less than the next three emails.

Updates, and what stopping means

New adapter versions arrive through the update channel for as long as you are subscribed. There is no licence key in the adapter and no kill switch: if you stop paying, nothing switches off. The version you have keeps running and stops receiving updates. How that works per platform is written out inthe updates page.

That is a real promise and it has a limit worth stating. An adapter that no longer receives updates will eventually meet a platform version, a PHP version or a change at EasternGraphics that it was never built for. It will keep working until something around it moves.

What we depend on

pconnector sits between your shop and pCon, which means two parties outside this contract can affect it: EasternGraphics, who publish the data and approve your domain, and the manufacturer, who decides what data exists and whether you may use it. We cannot promise availability of either, and neither can anyone else. What we can do is tell you quickly when one of them is the cause, which is whythe troubleshooting page names the symptoms that point outward.

Liability and law

Liability is limited to [aansprakelijkheidsgrens]. Dutch law applies and disputes go to the court in [bevoegde rechtbank].

One thing we will not limit away: if a price reaches a cart without a valid signature from EasternGraphics because of a fault on our side, that is our problem to fix and our problem to pay for. The verification exists precisely so that cannot happen, and it is on by default for that reason.
